>> thanks for joining us tonight. the news keeps coming. here's brian with the news edge at 11:00. starting the news edge off tonight in dc with a vigil this evening near catholic university for a grosser shot dead inside his store over the weekend. raj patel's killers are still on the loose. bob barnard was at the vig and i will has more from the news room. >> reporter: the community was embracing the murder victim's family while urging police to hurry up and catch the killers. it started with a procession of more than 100 relatives, friends, neighbors and strangers walking the block from nearby saint anthony's church to the murder scene at 12th and newton

street northeast. >> this is what brooklyn is about. you touch one of us, and it affects all of us. we're not going to let this guy g. >> it says a lot about our community. we're not total strangers. >> in the face of this unspeakably horrible tragedy --. >> reporter: with their candles and sad faces, they gather outside the corner market where raj patel was shot dead around 6:30 saturday night. he was 46 years old from bowie, maryland, apparently unarmed when he was shot by at least two gun men. [music] >> it's nice that the whole community can get together and do something, even though it's something small, but i felt it was really important that i came out and brought my son out with me to show our condolences for the family. >> chris is taking this very hard. >> reporter: chris patelewas inside the store with his mother when his father was shot. after the vigil, he was mobbed

by well wishers with hugs and tears of words of support. >> we were really surprised of the turnout, so we were really thankful for the neighbors we have. >> thank you for everything. >> reporter: the patels have owned the store about two years, have never been robbed before and say they're not sure they'll reopen for business. >> it's still kind of unbelievable to even think it happened right here. >> reporter: police say security cameras inside the store recorded the shooting. police now hoping the surveillance video will help them identify the killers. police say the gunmen wore masks, but had distinctive mannerisms which may help somebody recognize the killers and turn them into police. we're told investigators have images from that surveillance video ready to show you, but not tonight. if we get them tomorrow, you'll see them, and perhaps help police solve the case, brian. >> bob, our other big story we're following tonight, the death of a man near a dc night club now ruled a homicide. the dc medical examiner released

their findings on ali ahmed mohammed who died in october. his death had four contributing factors, including physical exertion and heart trouble, but the report does not show mohammed was beaten, as witnesses first told police. on fox 5 news at 10:00 tonight, dc police chaff kathy linear expressed no regrets with how the case was initially handled with the arrest of five dc employees and her calling it vigilante justice. >> i'm going to have critics no matter what i say or what i do, and often times, it can go both ways. you know, i made a statement. the statements were made. we now have a ruling, so this has to play out. i think once this goes through the justice system, questions will get answered as we go forward. we now have a ruling that the manner of death was homicide. so let's start there and go forward. . the edge on maryland now where police are on the lookout

for two men who shot and killed a 19-year-old near kennedy high school. the school was placed on cold blue as a precaution. it happened around 1:30 this afternoon on hutchison lane in silver spring. the teen was hit in the chest and died at the hospital. the suspects drove away. four teenagers are recovering after a scary accident in maryland. three girls and a boy were in a van when it overturned near parkdale high school. they were all students of the school and taken to the hospital to get checked out. we're told their injuries are minor and no word on what caused the accident. today, the senate took a major step towards ratifying a new nuclear arms treaty. some republicans arm it could open up the united states to attack, not from russia, but from iran or any other rogue state that has nuclear missiles. here's more from capitol hill. >> reporter: nearly half dozen republicans crossed party lines to join democrats in support of

starting the stark treaty frsdz final passage. >> having voted in the affirmative, it's agreed to. >> reporter: we would start treaties between american and russia that limited both countries to 1,550 war heads and 800 launchers. but republicans are blasting the deal. >> they are committed to jamming this through at any coast. >> reporter: opponents say the u.s. gave up too much missile defense capability in the deal, and the concern is over iran or another countries building a missile. >> the real threat is a rogue missile attack or accidental launch, so what we're about to do is negotiate away something we desperately need. >> this treaty was signed in april and under the u.s. constitution it needs to be ratified by 2/3 of the senate, which is currently in the lame

duck session. russia has warned any changes to the treaty could kill it, and the delays should end. >> there have been 18 committee hearings on this, 1,000 questions. >> reporter: senate democrats are striking back at the treaty's opponent saying the deal will bring the u.s. and russia closer together should an outside nuclear threat develop. >> there is nothing in the treaty that prevents the united states from doing whatever it wants to on missile defense. that is very clear and the president has made it very clear and negotiators have made it very clear. >> reporter: having reached the 67 vote mark to move the treaty forward, it appears clear it will be fully approved on wednesday. on capitol hill, tom fitzgerald, fox 5 news. winter misery in europe, and and travellers are continuing to pay the price. >> reporter: still on a reduced flight schedule at heath row airport. passengers are sleeping on the floor at the airport. the problem is keeping up with all the ice and snow on the

runways, and with freezing forecasts continuing, the chaos may extend into christmas. a woman with a gun brought a halt to the 5:00 news at a charlotte tv station in north carolina. swat team members were called to the studio of the abc affiliate wsoc. the building was evacuated. one witness says the woman was distraught over something but was not angry with the station. a mob creating more of a stir than expected. roseville mall in northern california was evacuated after 5,000 people gathered to watch the flash mob sing holiday tunes. witnesses say the floor started moving and creeking. everyone got out but investigators say the building is structurally sound. dc's population has crossed the 600,000 mark. research shows it's the first growth for the district since 1950. it won't change its representation status in congress but it will in dozens

>> latest census figures are out. it's more than 308 million people in the u.s.. however, fewer people are living in the northeast and midwest. more people are living south and outwest. 10 states will lose seats in the house. illinois, iowa, massachusetts, michigan, missouri, new jersey and pennsylvania will lose one seat. new york and ohio will lose two. arizona, florida, georgia, nevada, south carolina, texas, utah and washington will gain congressional seats. nevada was the fastest growing state. its population increased by 35% over the past 10 years. the future of maryland horse racing still remains up in the air tonight.

earlier today, the maryland racing commission left without reaching an agreement on a racing calendar next year. the track owners were asking for a smaller calendar trying to save cash. the horse community says it would cost them their livelihood. beth parker has both sides. >> reporter: the preakness. it's 1/3 of horse racing's prestigious triple crown. the real battle is in this room at laurel park, a show-down before the maryland racing commission that some say could kill horse racing in maryland. >> this ownership has brought maryland racing to the verge of ruin and we all know it. the question is what do we do in the short term while we figure out a long term solution. >> reporter: mi development currently jointly owns the track with gaming. he says they're losing millions to other parks. >> i will do everything we can to have horse racing but it's got to make economic sense.

we can't year after year subsidize the racing facilities here. >> reporter: horse groups and track owners cannot agree on how many races will be run in 2011, and how money will be spent and earned. so tuesday afternoon, the maryland racing commission voted no to deny the track owner's proposed business plan and its application for 2011 racing dates. >> we need ownership willing to operate this business on a year-round basis. >> reporter: there's fear the disagreement could bring an end to racing in maryland under the current ownership. >> it's difficult. many sleepless nights. you don't know, you know -- we all depend on this industry from the bottom to the top, and it's difficult. >> reporter: some at today's meeting urged governor o'maly to step in and take the tracks using eminent domain. a spokesman for the governor today says they're exploring all

legal options. the governor says he will do whatever it takes to protect horse racing in maryland in general but governor o'malley is forcing the two sides back to the table. christmas holiday can bring cheer and a little stress. a study blames a symbol for the holiday season and makes them uneasy. if you log onto facebook, there might be something you're tempted to click on. why you don't want to know who's deleted you. you're bound to find something you like. ask those arrested inside the rap star's connecticut mansion. when cops showed up, they took the guy in blue into custody and the second guy was harder to find because he was hiding away in the closet pounding a bottle of wine. no word on what the wine was, but both apparently had a taste for marijuana, because they were busted for that as well.

on all your friend walls and that link takes you to a site promising an iphone if you fill out a survey but admits there's no gift. the cdc says it's far from what it should be. only a third of all people over the age of 18 got a flu shot last year and levels were lower for many other vaccines. number 3 is promising news for the rate of babies being born to u.s. teenagers is at the lowest level it's been in almost secht 70 years. some experts believe the poor economy is responsible in the drop of overall birth rate. number 2, christmas trees don't bring everyone holiday cheer. a new study shows people who don't celebrate the holiday feel uneasy and less sure of themselves around christmas trees,le who do celebrate have less positive reaction. new net neutrality rules

could cost you. your internet service provider can't block access to competitor's site and will also allow them to charge you based on the amount of band width you use. brian, that's tonight's fox 5 top 5. . a lot of folks are trying to plan for christmas, weekend traveling, at least this system that's coming. whatever it ends up being, it's not coming a couple of days before. >> i think what we're seeing with the trends with this is that it's slowing down , that it may be a christmas night, next day type thing, farther south and maybe up the coast but the curve could take it out to sea too. four days out and there's a lot of play, and as usual, with all of our winter storms, the track will be crucial and coming up the coast will give us a better shot of snow. i think it's going to be the 25th and 26th when it hits.

on true view, we'll see a couple of flurries scooting from west to southeast. if you see that tonight, it's a little bit of energy traveling by quickly. should not cause any problems. here is the problem maker though, and we're going to take you out to the west coast where our vipir is showing us the massive rain storm that continues to pound, and snow storms or the mountains and the sierras. this is hitting california. this is, in fact, the energy that we will spend the rest of this week tracking to see what it is going to be bringing to dc. about 7inches of rain across southern california. on one hand, that's good to get the snow in the mountains because that's where they get the drinking water but they're experiencing flooding, mud slides and high water rescues going on. it's certainly going to be staying cold the next several days. we did get up and over 40 today.

tomorrow about 39 degrees and maybe a few flurries tomorrow. thursday, pretty dry, breezy, christmas eve dry, 38 degrees. a lot of sun, maybe clouds later in the day, and saturday, christmas day, about 35 degrees. and, of course, that's when we'll really begin to see whether or not our storm is going to bring us the potential for a white christmas or a late white christmas. 35 degrees in the district right now. it's really not as cold as it has been on other nights, because we do have a good cloud deck around. upper 20s to the north, pittsburgh coming in at that. our forecast tonight, pretty settled, mostly cloudy and chilly with upper 20s in the district, low and mid-20s in the suburbs. tomorrow maybe a passing flurry. your best chance is south and west of dc for that. 39 degrees. your clouds than sun, but some sunshine. if we brighten up, it will be the afternoon as the system passes by so perhaps a little bit near sunshine by 4:00, our

second day of winter. max hd future cast, we'll run it out to 7:00 in the morning. not too much in the way of flurries but there could be some in the mountains and you could get clipped south and west of dc. we continue running it out to see what's going on in our system. friday night, christmas eve, still in the center part of the country so we know it's in fact slowing down. where it tracks after that will be incredibly important for what we end up getting around here. could be anywhere from light snow to enough to cause some disruptions for the late on the 25th and 26th. we're in the 30s next several days. our chances of snow come in saturday and sunday. we're keeping a close eye on all of that. we have hockey highlights when we return.

first nhl goal. caps up 1-0. dave stekle, stuff attempt, his first of the year. later in the second. the huszle by jason trimera. loses the battle for the loose puck and still manages to score. caps 3-1. alex oveskin into the devil's zone, loses it but cleans it up. fourth of the year, the caps defeat the devils 5-1 for a second consecutive win and the head coach likes his youngsters. >> they have lots of energy, and they follow direction, and they played with passion and enthusiasm, and when you do that, usually no matter what league you're in, you're going to have success. there's reasons they've won two collar cups in a row and been in the final 4 the last five years. donovan mcnabb continued his tuesday treads of talking turkey to local radio. it was the first time mcnabb had
